1. Acceptance of Terms
By accessing or using the FixedRoom platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
FixedRoom is an online marketplace that connects property owners (“Hosts”) with individuals seeking accommodation (“Guests”) in the United Arab Emirates and Maldives. We facilitate the listing, discovery, and booking of properties with fixed, all-inclusive pricing.
3. User Accounts
You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4. Booking and Payments
All prices displayed on the platform are fixed and all-inclusive, covering the base rental amount, utilities (DEWA), WiFi, cleaning fees, and service charges unless otherwise stated. Payments are processed securely through our payment partners. By making a booking, you agree to pay the total amount shown at the time of booking.
5. Cancellation and Refunds
Cancellation policies vary by property and are clearly displayed on each listing. Three policy types are available: Flexible, Moderate, and Strict. Please review the applicable cancellation policy before making a booking. Refunds are processed according to the cancellation policy in effect at the time of booking.
6. Host Responsibilities
Hosts are responsible for ensuring their listings are accurate, properties are maintained to our quality standards, and all applicable local regulations are met. Hosts must honour confirmed bookings and provide the amenities and facilities described in their listings.
7. Guest Responsibilities
Guests agree to treat properties with care and respect, comply with house rules set by the Host, vacate the property by the checkout time, and report any damages promptly. Guests are responsible for any damage caused during their stay beyond normal wear and tear.
8. Prohibited Activities
You may not use the Service for any unlawful purpose, to violate any laws or regulations, to infringe on others' rights, to submit false or misleading information, to upload malicious content, or to interfere with the proper functioning of the Service.
9. Limitation of Liability
FixedRoom acts as an intermediary between Hosts and Guests. We do not own, control, or manage any listed properties. To the maximum extent permitted by law, FixedRoom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be resolved in the courts of Dubai, UAE. For users in the Maldives, local consumer protection regulations also apply.
